Terms of service
These General Terms and Conditions (GTC) for in-store and online e-shop sales regulate the rights and obligations of éméo for purchases made by customers. Any modification of these GTC requires the written agreement of éméo.
2. Information about e-shop products
The information and illustrations regarding the products are carefully prepared by éméo for its customers. However, differences from the delivered products cannot be completely excluded. Only the descriptions, information, and any other indications on the original product packaging are binding. The end user of the products purchased in-store or from the e-shop always verifies that the products are suitable for their intended use and that there are no intolerances or contraindications for the end user. 3. Product Offering
The offering is limited to Switzerland, the Principality of Liechtenstein, the European Union (certain countries), and applies only for private or personal use. éméo may impose quantity restrictions in the e-shop for certain products.
4. Order and Contract Conclusion through the e-shop
The products and prices published in the e-shop are considered non-binding offers by éméo to its customers. The customer accepts the general conditions and, by clicking the order submission button, submits a legally valid offer for the conclusion of a purchase contract.
The contract becomes effective upon receipt of the order payment confirmation. This payment confirmation serves as acceptance of the general terms and conditions of sale by the customer. Once the order is validated and paid, the customer receives an order confirmation by email.
Any contract is subject to the suspensive condition of product availability at éméo.
All prices are in Swiss Francs (CHF), including value-added tax (VAT), but excluding shipping costs for Switzerland. For other countries, prices are in the currency of the country, including the country's value-added tax (VAT), but excluding shipping costs. The invoiced price is the price indicated on the order confirmation sent to the customer. Technical modifications, errors, and printing mistakes are reserved. éméo reserves the right to modify its prices at any time and without prior notice. The products remain the property of éméo until full payment of the invoice.
6. Delivery Fees
For any e-shop product order, the delivery fees for Switzerland are calculated based on the purchase value and are automatically included in the order basket. From a purchase value of CHF 95.– including VAT, éméo covers the shipping costs by economy mail. If the total purchase amount does not exceed CHF 95.- including VAT, a flat rate of CHF 9.50 will be added to the invoice for shipping fees.
For international shipments (outside Switzerland), shipping fees will be calculated based on the weight of the package and the delivery address. Customs fees are included in the price for orders within Europe. For international shipping, import fees or taxes are the clients responsibility and not included in the price.
7. Payment Conditions and Methods for e-shop Orders
The customer uses one of the payment options specified in the e-shop. In the case of payment by credit or debit card, the data is transmitted encrypted and is subject to a high-level security system. All payment transactions are carried out in a secure area in accordance with the highest security standards.
The order will be considered effective after confirmation of the agreement by the banking payment centers. éméo will promptly confirm the order by email in accordance with applicable law.
In accordance with current regulations, and to ensure the security and confidentiality of their information, éméo does not store its customers' banking data, even when encrypted. Therefore, it is the customer's responsibility to save and print their payment certificate if they wish to keep the payment details related to their order.
8. Delivery Conditions for e-shop Orders
The products are shipped within three to five working days following receipt of the order.
In the case of orders for products that are not available in stock and cannot be delivered within five working days, the order may be fulfilled in multiple shipments. There are no additional shipping fees for the customer.
If the customer has entered a different delivery address than the billing address, they assume responsibility for the shipment to the delivery address. éméo is not liable if the delivery address is incorrect or if no recipient receives the shipment.
9. Exchange, Transport-Related Damages, and Returns
The products offered in the e-shop by éméo leave the éméo premises in perfect condition and cannot be returned or exchanged. éméo cannot be held responsible for any transport-related damages as the transfer of risks to the customer occurs upon delivery of the goods to the shipping company.
Exceptions to this provision include products delivered in error or products that have defects upon delivery to the customer. In the latter case, the products are returned to éméo in their original packaging at the customer's expense, and the customer receives a replacement delivery if the merchandise is available or, failing that, a refund.
éméo mandates Swiss Post for the shipment of sold goods. For any transport-related damage, the customer should directly contact the transport company that delivered the product (Swiss Post in Switzerland and local postal services abroad). If the products sent to the address indicated on the order form do not reach the destination, the customer should contact éméo directly at the address indicated in paragraph 10 - Customer Address and Contact Email.
The customer is responsible for immediately checking the received products. If any defects are not notified in writing to éméo within two (2) business days after receiving the products, they are deemed accepted.

In case of warranty claims due to product defects, only the manufacturer's provisions apply. éméo expressly excludes any other warranty.
12. Intellectual Property and Use of Rights
éméo is the owner of the brand, design, method, copyright, know-how, and all intellectual property rights. These may not be used by the customer without prior written authorization from éméo.
éméo has the right to use all its intellectual property rights, including all ideas, concepts, programs, and processes developed in carrying out its services for the customer, whether for itself or in conjunction with employees, collaborators, or other agents of the customer.
The various intellectual property rights developed during the contract with a customer remain the property of éméo, except for express agreement between the parties.
13. Data Protection and Confidentiality
éméo treats customers' personal data strictly confidentially in accordance with applicable laws. However, customers are informed that data recorded in connection with the conclusion of the contract may be collected, processed, and used for anonymous statistical evaluations to recognize trends and improve the offer.
These are only non-personal information that does not allow for customer identification.
All éméo employees are bound by professional secrecy towards the customer. The secrecy applies to all information that employees have become aware of. The secrecy applies to any form of communication, regardless of its form and scope.
However, only data that must be transmitted to partners entrusted with the provision of the service (e.g., addresses for transport and logistics service providers) are communicated to third parties.

14. Final Provisions and Jurisdiction
éméo reserves the right to modify these GTC at any time.
In case of uncertainties related to translations, the French version of the GTC prevails. If any provisions of these GTC are found to be inapplicable or void for any reason, the validity of the other provisions is not affected.
The only applicable law is Swiss law, excluding private international law (LDIP).
The Court at the headquarters of éméo has sole jurisdiction to judge any dispute relating to the interpretation and execution of these legal conditions. However, in the case of an action brought by a consumer in Switzerland, the court at the headquarters of éméo or the consumer's place of residence (Art. 32, para. 1, letter a CPC) shall have jurisdiction.
